Senator Daines emphasized the foundational principles of governance as outlined by the Founding Fathers, stating, "One judge in one part of the country does not have unilateral control over the entire nation, and as activist judges work overtime to stop President Trump’s agenda, it’s clear we need this commonsense measure to prevent judicial overreach and stand up for the principles in the U.S. Constitution."
The JRCA proposes amendments to both the “Administrative Procedure Act” and the “Declaratory Judgment Act." It includes provisions that make temporary restraining orders immediately appealable. The legislation's supporters highlight these amendments as necessary steps to define the constitutional role of the judiciary.
